Correct Answer - Option 3 : The Chief Executive Officer of Zilla Parishad can only preside over the meeting called for the passing of the no-confidence motion.

The correct answer The Chief Executive Officer of Zilla Parishad can only preside over the meeting called for the passing of the no-confidence motion.

  • Maharashtra Zilla Parishads and Panchayat Samitis Act, 1961.
  • Section 49 The motion of no-confidence against President and Vice-President
    • The Zila Parishad is the topmost tier of the panchayat raj system and acts as the link between the state government and the village-level Gram Panchayat.
    • A motion of no confidence may be moved by not less than [one third] of the total number of the members. Hence 1 is correct.
    • A President or a Vice-President shall cease to be the President or the Vice-President, as the case may be, if a motion of no-confidence is passed, at a special meeting of the Zilla Parishad, by [a majority of two-thirds] of the total number of elected Councilors. Hence 2 is correct.
    • where the office of the President is reserved for a woman, is held by a woman President, such motion of no-confidence shall be passed only by a majority of not less than three-fourth of the total number of the councilors who are for the time being entitled to sit and vote at any meeting of the Zilla Parishad. Hence 4 is correct.
    • The meeting shall be presided over by the Collector or any officer authorized by him on this behalf. The Collector or such officer shall, when presiding over such meeting, have the same powers as the Chairman when presiding over a Panchayat Samiti meeting has, but shall not have the right to vote. Hence 3 is incorrect. (not only)
