  • The Preamble is known as the introductory note of the Indian Constitution.

  • The preamble was modified under the 42nd Constitutional Amendment Act in 1976, Three new words Socialist, Secular, and Integrity were added.
  • Under this amendment, the word ‘sovereign democratic republic’ was changed to ‘sovereign socialist secular democratic republic’ and the words ‘unity of the Nation’ were changed to ‘unity and integrity of the nation’.
  • The 42nd amendment is considered the most controversial amendment in the constitution as it attempts to reduce the power of high courts and the supreme court.
  • Under this amendment, the fundamental duties of Indian citizens were laid down and it brought the most widespread changes to the Indian Constitution.
  • The word ‘Secular’ got inserted in the Preamble of the Constitution of India through the 42nd Constitutional Amendment Act of 1976.

  • The term “Secular” means being "separate" from religion or having no religious basis.
  • Secularism means the separation of religion from political, economic, social, and cultural aspects of life, religion is treated as a purely personal matter.
  • Indian Secularism is also reflected in its fundamental rights (Article 25-28) where it guarantees each of its citizens the right to practice any religion.

Components of the Preamble:

  • Date of Adoption: 26th November 1949.
  • It states that the Constitution derives its power from the people of India. Hence, statement 1 is incorrect.
  • It states India to be a Sovereign, Socialist, Secular, Republic & Democratic state.
  • It specifies Justice, Liberty, Equality, & Fraternity as the objectives of the Indian Constitution.
  • According to the Hon'ble Supreme Court of India, 
    • It is non-Justiciable i.e its provisions are not enforceable in a court of law.
  • The Preamble is neither a prohibition upon the powers of the Legislature nor the source of power to the Legislature. Hence, statement 2 is correct.
  • Republic and the ideals of liberty, equality, and fraternity are borrowed from the French Constitution.
  • The ideal of justice (social, economic, and political) in the Preamble were borrowed from the Soviet Union (Russia) Constitution.
