Correct Answer - Option 1 : Section 17

The Right of Children to Free and Compulsory Education Act, 2009 (or, Right to Education Act or RTE Act) has important provisions and implications for the teachers working in elementary schools. 

These provisions are as follows:

Section 17:

  • No child is subjected to physical punishment or mental harassment.
  • Whoever contravenes the provisions of sub-section (1) shall be liable to disciplinary action under the service rules applicable to such person.

  • Section 8  assigns duties to the appropriate Government to ensure that it provides free and compulsory elementary education to every child, in a neighborhood school.
  • Section 26: The appointing authority, about a school, established, owned, controlled, or substantially financed by funds provided directly or indirectly by the appropriate Government or by a local authority, shall ensure that vacancy of teacher in a school under its control shall not exceed ten percent.

Hence, we conclude that Section 17 told that corporal punishment to a child is treated as torture.
