The framers of the American Constitution wanted to prevent separate branches from encroaching upon one another, and to avert deadlock, the fathers of the Constitution provided an elaborate system of checks and balances. The judicial organ is checked by the fact that all the Judges are appointed ‘by the President with the approval of the Senate.’ Then, all judges can be impeached. The Congress can determine the size of the courts.
