  • The Constitutional Bench that invalidated the NJAC ( National Judicial Appointments Commission) Act was headed by Justice J.S. Kehar.
  • The bench consisted of 5 judges. The Bench in a majority of 4:1 rejected the NJAC Act and the Constitutional Amendment as “unconstitutional and void.”
  • The panel of five judges consisted of - Chelameswar, Madan B. Lokur, Kurian Joseph, and A.K. Goel.
  • The Act was invalidated after the judgement by the panel on 16th October 2015.

  • The NJAC Act and the Constitutional Amendment Act came into force on 13 April 2015. 
  • The NJAC Bill 2014 that established the NJAC was introduced and passed by both houses of Parliament with the Constitutional (99th Amendment) Bill 2014.
  • The NJAC proposed to make the appointment of the high court and Supreme Court judges and chief justices more transparent.
  • According to the Act, the judges will be selected by the commission, whose members will be drawn from the judiciary, legislature and civil society.
  • The members of NJAC according to the Act are:
    • The CJI will be the chairperson.
    • The next two seniormost Supreme Court judges.
    • The law and justice minister.
    • Two eminent persons, to be selected by a committee comprising the CJI, Prime Minister and leader of the opposition.
