The correct answer is 42nd

  • The original Constitution did not provide for the Fundamental Duties of the citizens.
  • These were added through the 42nd Constitutional Amendment Act of 1976.
  • It incorporated the fundamental duties by inserting a new Article 51A below article 51. 
  • The concept of Fundamental Duties has been borrowed from the Russian (Former Soviet Union) Constitution.
  •  The 10 fundamental duties were also added as per the recommendations of the Sardar Swaran Singh Committee.
  • The objective of incorporating the fundamental duties is to place before the country a code of conduct, which the citizens are expected to follow.

 

  • The Twenty-fourth Amendment of the Constitution 1971, enables Parliament to dilute Fundamental Rights through Amendments of the Constitution.
  • It also amended Article 368 to provide expressly that Parliament has the power to amend any provision of the Constitution.
  • The Thirty-eighth Amendment of the Constitution 1975, made the declaration of "The Emergency" final and conclusive.
  • In particular, it codified and enlarged the State's power to remove fundamental rights from its citizens during states of emergency.
  • The 44th  Amendment aimed to undo several changes that had been made to the Constitution by the 42nd Amendment which had been enacted by the Indira Gandhi-led Indian National Congress during the Emergency.
