a) Identity theft
A user’s identifiable personal data like demographic details, email ID, banking credentials, passport and various such personal data are stolen and misused by the hacker on behalf of the victim.
An example
Financial identity theft: when the stolen identity is used for financial gain.
Section 66C of IT Act 2008 describes for this type of crime.
Section 66C: Punishment for identity theft - Whoever, fraudulently or dishonestly make use of the electronic signature, password or any other unique identification feature of any other person, shall be punished with imprisonment of either description for a term which may extend to three years and shall also be liable to fine which may extend to rupees one lakh.
b) Credit card account theft
Credit card theft is a type of identity theft that occurs when someone accesses your credit card account and uses it to make unauthorized purchases.
Cyber Appellate Tribunal has been established to resolve disputes arising from cyber crime, such as tampering with computer source documents, hacking the computer system, using password of another person, publishing sensitive personal data of others without their consent, etc. The act is needed so that people can perform transactions over the Internet through credit cards without fear of misuse.
